1. Acceptance of Terms
By accessing or using GETCOLLAB TECHNOLOGIES PRIVATE LIMITED ("GetCollab", "the Platform"), you accept and agree to be bound by these Terms of Service ("Terms"). If you are accepting these Terms on behalf of an organization (for example, a Brand), you represent that you have the authority to bind that organization, and "you" refers to both you and that organization. If you do not agree to these Terms, do not use the Platform.
2. Eligibility
- You must be at least 18 years old to create an account or use the Platform
- You must provide accurate, current, and complete information when registering
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account
3. Description of Service
GetCollab is a marketplace platform that connects Brands with Creators in India for marketing campaigns, deals, and collaborations. Our services include:
- Campaign creation and management tools for Brands
- Creator discovery, profiles, and campaign matching
- Deal proposal, negotiation, and workflow tools between Brands and Creators
- Escrow-based payment handling, so Brands can fund deals and Creators can be paid on completion
- Paid subscription plans and organization seats for Brands
- Communication tools between Brands and Creators
4. Role of GetCollab in Transactions
GetCollab is more than a passive listing service. We actively facilitate deals between Brands and Creators, and depending on the deal, we may:
- Hold funds in escrow on behalf of a Brand until agreed deliverables are approved or a deal is otherwise resolved
- Release escrowed funds to a Creator, or refund them to a Brand, according to the deal's workflow and these Terms
- Charge disclosed platform fees on transactions, deducted from the amount released, as set out in Section 8
- Offer paid subscription plans and organization seats to Brands, as set out in Section 9
- Assist in resolving disputes between Brands and Creators, as set out in Section 12
GetCollab is not a party to the underlying commercial agreement negotiated between a Brand and a Creator for a specific deal (for example, the scope of content, creative direction, or brand guidelines), and we do not guarantee the quality, timeliness, or authenticity of deliverables. However, we are not a mere pass-through: we provide the escrow, fee, and dispute-handling infrastructure described in these Terms, and our liability in connection with that role is set out in Section 17.
5. Account Types and Organization Seats
5.1 Creator Accounts
Creator accounts allow individuals to build a profile, connect social accounts, and respond to or negotiate campaigns and deals with Brands.
5.2 Brand Accounts and Organization Seats
Brand accounts are organized around an organization with one or more seats. Each organization has:
- Admin seat(s): Manage the organization's billing, subscription, team members, and have full access to the organization's campaigns, deals, and escrow activity
- Member seat(s): Can be invited by an Admin to collaborate on campaigns and deals within the limits granted by the organization, subject to the organization's subscription plan and seat limits
Organization Admins are responsible for the actions of Members they invite, and for removing seat access when a team member should no longer have it.
6. Campaigns
- Draft campaigns: Campaigns in draft status have not been published and can be permanently deleted by the Brand at any time
- Published/active campaigns: Once a campaign is published or has active creator interest, it cannot be hard-deleted. Instead, a Brand may pause, close, or archive the campaign
- Paused campaigns: Temporarily hidden from new creator discovery; can be resumed by the Brand
- Closed/archived campaigns: No longer open to new proposals; existing deals tied to the campaign continue through to completion, cancellation, or dispute resolution under Sections 7 and 12
7. Deals, Workflow, and Escrow
7.1 Deal Workflow
A deal moves through stages that typically include proposal or invitation, negotiation, contract agreement, content production, publishing, and payment/completion. Either party may cancel a deal before it is funded, subject to any campaign-specific terms agreed between the parties. Once a deal is in progress, cancellation may be subject to partial payment obligations as described in our Cancellation & Refunds Policy.
7.2 Escrow Funding and Release
- Brands fund escrow for a deal before, or as agreed within, the deal workflow
- Funds are held in escrow until the Creator's deliverables are submitted and approved, or the deal is otherwise resolved
- Upon approval, escrowed funds are released to the Creator, less the applicable platform fee, and paid out through our payment processor
- If a deal is cancelled before completion, or a dispute is resolved in the Brand's favor, escrowed funds may be refunded to the Brand in whole or in part, as described in our Cancellation & Refunds Policy
- Escrowed funds may be partially released where a deal is completed in part (for example, per milestone)
7.3 Disputes
If a Brand and Creator disagree about whether deliverables meet the agreed terms, either party may raise a dispute before escrow is released. We may request evidence from both parties and make a determination on the release, partial release, or refund of escrowed funds, as described in Section 12.
8. Platform Fees
GetCollab charges a platform fee on deal transactions processed through escrow. The applicable fee is disclosed to you before you fund escrow for a deal or accept a deal that will result in a fee, and is deducted from the amount released to the Creator (or otherwise itemized, as applicable). Fee amounts and structures may change from time to time; the version disclosed to you at the time of a given transaction governs that transaction. Current fee information, along with subscription pricing, is available at getcollab.in/pricing.
9. Subscriptions and Billing
- Creator accounts are free to create and use for participating in campaigns and deals
- Brand organizations may access certain features on a free basis and may also purchase a paid subscription plan for additional seats, features, or usage limits
- Paid subscription plans, seat limits, trial periods (where offered), and pricing are described at getcollab.in/pricing, which is incorporated into these Terms by reference and may be updated from time to time
- Subscriptions renew automatically at the end of each billing period unless cancelled before renewal, in accordance with our Cancellation & Refunds Policy
- Platform fees on deal transactions (Section 8) are charged in addition to, and independently of, any subscription fee
10. Payments and Payment Risk
- Payments, escrow funding/release, payouts, and subscription billing are processed through Razorpay and/or other payment processors we may engage from time to time
- You authorize us and our payment processor to charge, hold, and disburse funds as necessary to operate escrow, payouts, and subscription billing under these Terms
- Payments may be delayed, reversed, or fail due to issues with a payment processor, bank, or card network that are outside our control
- GetCollab is not liable for delays or failures caused by external payment providers, but will make reasonable efforts to help you resolve payment issues connected to escrow or payouts
11. User Responsibilities
11.1 Brand Responsibilities
- Provide clear and accurate campaign requirements and deal briefs
- Fund escrow and pay agreed amounts for approved deliverables in a timely manner
- Respect intellectual property rights in content delivered by Creators
- Manage organization seats responsibly and remove access for departed team members
- Provide timely feedback, approvals, or dispute evidence within the deal workflow
11.2 Creator Responsibilities
- Deliver work as specified in the agreed deal terms
- Provide authentic profile information and engagement metrics
- Comply with applicable advertising and disclosure regulations for sponsored content
- Maintain professional communication throughout the deal workflow
12. Dispute Resolution
In case of disputes between Brands and Creators over a deal or escrow release, we follow this process:
- Step 1 - Direct communication: Parties should first attempt to resolve the dispute directly within the deal workflow, typically within 7 days
- Step 2 - Support intervention: If unresolved, either party can raise a support ticket. We will review the submitted evidence, generally within 5 business days
- Step 3 - Mediation: GetCollab may offer mediation to help the parties reach a resolution
- Step 4 - Determination on escrow: Where escrow funds are involved and the parties cannot agree, GetCollab will make a determination on the release, partial release, or refund of the held funds, based on the evidence provided and the agreed deal terms
Liability limits: Except for our obligations regarding escrow funds held on your behalf, GetCollab's liability in any dispute is limited to the platform fees paid for the specific transaction in question. We are not liable for indirect damages, lost profits, or consequential losses arising from a dispute between users.
13. Third-Party Integrations (Meta/Instagram)
GetCollab integrates with Instagram and Facebook APIs to provide enhanced services. By using the Platform, you acknowledge and agree to:
- Comply with Meta's Platform Policies, Terms of Service, and Community Guidelines
- Accept that Instagram/Facebook services are subject to their own terms and policies
- Understand that we are not responsible for changes, suspension, or termination of third-party services
We reserve the right to modify or discontinue integration features if required by Meta or for compliance purposes.
14. Prohibited Activities
Users are prohibited from:
- Engaging in fraudulent activities or misrepresentation, including regarding escrow, payments, or deliverables
- Circumventing the Platform to conduct deal payments off-platform in order to avoid platform fees
- Harassment, discrimination, or abusive behavior
- Violating intellectual property rights
- Posting false or misleading information
- Using automated systems or bots to manipulate campaigns, bids, or metrics
- Attempting to access unauthorized areas of the Platform, including other organizations' seats or data
14.1 Fraud and Misuse
We have zero tolerance for fraudulent activity. The following are strictly prohibited:
- Creating fake profiles or inflating follower counts
- Running misleading or scam campaigns or deals
- Engaging in payment fraud, chargebacks, or escrow manipulation
- Impersonating other users, brands, or organizations
- Manipulating engagement metrics or reviews
Consequences: We reserve the right to immediately suspend or terminate accounts involved in fraud, without prior notice, and to hold or reverse related escrow transactions pending investigation. Users found in violation may be permanently banned from the Platform.
15. User-Generated Content and Liability
Users are fully responsible for all content they create, post, or share on the Platform:
- You represent and warrant that you have all rights necessary to post the content you submit
- You are responsible for ensuring your content complies with applicable laws, including advertising and disclosure regulations
- GetCollab is not liable for content posted by users
- We reserve the right to remove content that violates our policies, without notice
16. Content and Intellectual Property
16.1 User Content
Users retain ownership of content they create. By posting content on GetCollab, you grant us a non-exclusive license to display, distribute, and promote that content on the Platform for the purpose of operating our marketplace.
16.2 Platform Content
All Platform features, design, and functionality are owned by GetCollab and protected by applicable copyright and intellectual property laws.
17. Platform Availability and Limitation of Liability
We strive to provide uninterrupted service but cannot guarantee it:
- No warranty that the Platform will be available at all times
- Downtime may occur due to maintenance, updates, or technical issues
- We are not liable for losses arising from service interruptions, except in respect of funds we are holding in escrow, which remain accounted for and will be released or refunded once the interruption is resolved
Subject to the escrow obligations described in these Terms, the Platform is provided "as is" and "as available", without warranties of any kind, and we are not responsible for the quality, accuracy, or legality of content posted by users, or for user conduct on or off the Platform.
18. Account Suspension and Termination
18.1 Suspension and Termination for Abuse
We may suspend or terminate any account, immediately and without notice, for violation of these Terms, fraudulent activity, abuse of other users, or misuse of the Platform, escrow, or payment systems.
18.2 Voluntary Account Deletion
You may request deletion of your account at any time through Account Settings or by contacting support. We will process the request unless it is blocked under Section 18.3.
18.3 Deletion Blockers
We cannot complete account deletion while any of the following remain open:
- Active or paused campaigns (for Brand organizations)
- Open or in-progress deals
- Escrow funds currently held for a deal involving your account
- Unpaid or pending settlements owed to or by your account
- Open disputes involving your account
We will let you know what needs to be resolved (for example, closing campaigns, completing or cancelling open deals, or awaiting release of held escrow) before deletion can proceed.
18.4 What Happens on Deletion
Once eligible for deletion, we anonymize your personally identifying information (such as your name, contact details, and profile data) so it can no longer be linked to you. We retain financial, invoice, and tax/GST-related records in anonymized or pseudonymized form for as long as required by applicable law, as described in our Privacy Policy. We do not perform a hard wipe of records we are legally required to keep.
19. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.
20. Changes to These Terms
We may modify these Terms at any time. We will notify users of significant changes via email or in-platform notification. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
